Daughter turning 18

I live in Illinois divorce was done in Mclean Co. My daughter will be 18 this September. My child support does not end until June 1 of 2007. She is now all of a sudden getting major medical work done. I provide insurance on her as per court order. She is needing braces for some reason and when I ask ex for medical records she tells me no and when I call the doctors office they do the same. All I am told is that I have to pay half of anything the insurance does not cover. One surgery is set for Jan of 2007 then the braces, then another surgery after that. But what if this goes past the child support order to where I have to carry insurance? Please help.

Does your court order grant you joint legal custody? If so, then you should have the right under federal law to see the child's healthcare records. Usually, court orders expressly provide for this, but if they don't and the healthcare provider will not give you info or records, then you will need to ask the court to issue a clarification order so you can obtain the records and info.

If you do not have joint legal custody, then you have no right to the medical information. You could still go to court and ask for a clarification order granting you access to the healthcare info, on grounds that you are being subjected to pay for procedures and you don't know whether or not they may be cosmetic, rather than reasonbly necessary.

I have found the "obtaing child's medical records" form. I plan on sending that to all doctors that my daughter see, do I need to send a copy of them also to my ex or a brief summary that I have sent them?

Please clarify what form exactly that you're referring to. If you mean some form on the SPARC website, please be advised that I do not work for SPARC nor have I reviewed any of their documents. So, I haven no opinion as to the utility of a form found on this website.
