I am the NCP, case is in MN.

The CP and I have agreed that child support should be modified and have agreed on an amount for monthly support.

The CP would like to offer the courts an agreement in hopes that they will approve and modify without an investigation.

Can you give me an example of an agreement that we could present the court?

Thanks for your help.

Some courts use "form" pleadings. If MN is such a jurisdiction, then your stipulated order must comport with the form, or the clerk may reject it.

If MN uses plain paper pleadings, then you could say something like:

Stipulated Order

The court, after considering the pleadings and evidence of the parties presented in this matter, and after having been fully advised, hereby finds that the parties to this action have agreed to all of the terms and conditions described in this stipulated order, and that their agreement comports with all applicable laws. Now, therefore, it is hereby ordered as follows:

1(a). ______ shall pay child support to _________, in the amount of $________, due and payable on the __________ of every month.

1(b) _________ shall maintain healthcare insurance coverage for the parties' minor child(ren), if available at reasonable or no cost from his/her employer; and, the parties shall divide any of the minor child(ren)'s uninsured healthcare costs ________________ (describe the division, e.g., Father: 60%, Mother: 40%, or whatever).

1(c) ________ shall divide the reasonable cost of employment or job-training related daycare for the parties' minor child(ren) ___________ (describe the division, e.g., Father: 100%, Mother 0%).

2. The above-stated child support award does/does not (circle one) represent a deviation from the Uniform State Guidelines.

3. Payment of the above-stated child support is in the parties' minor child(ren)'s best interests.

4. Subsequent modification of this child support order shall/shall not (circle one) require a material change in circumstances affecting the child's best interests.

5. This order shall be deemed retroactive to  _______ (date of retroactivity/effect; if effective as of date of entry, then state "the date of entry of this order.").

6. The obligation to pay child support for any individual child under this order shall terminate when the child for whom support is owed __________ (state the statutory grounds for termination of support, e.g., marries, dies, reaches 18 years of age, and is graduated H.S., or reaches 19 years of age, whichever occurs first, etc.).

Agreed by the parties:
