The EX got away with MURDER

Some of you may remember me posting under the subject "dealing with GAL".  Well the time came and we had our day in court.  GAL wants us to go in for a psychological evaluation before coming to a decision.  

Mind you, this GAL also knows that the EX had a 2 year old die in her house under the careful eye of her boyfriend whom he's being charged with homicide.  They called it "shaken baby syndrome".  He's currently out on bail which the judge dramacticall reduced from $250,000.00 to $20,000.00 plus ordered no contact with the mother.  

The mother had tried to cover up the fact she wasn't at home at the time her child was "shaken".  She repeatedly lied to the police, as well as GAL.  Which by now, both know the truth.  She kept telling people she was at home doing laundry.  Which she wasn't.  CPS, GAL, FAMILY COURTS see no harm in allowing her to retain joint custody and joint placement of the two older children we share.  On top of that, the GAL still doesn't see an issue with allowing her to maintain contact with the children.  Everything thus far has pretty much stayed the same.  

What's new however is that Patrick Donely who was charged for killing her 2 year old pleaded "not guilty".  And started pointing the finger at the mother stating it was all her idea to hide and conceal what really happened.  NOW, I am not a lawyer and certainly don't play one on TV.  But if you hinder an investigation in any way shape or form, one would call that obstruction of justice.  Also, if you try to hide and conceal an ongoing investigation knowing that you know the truth, you would be condsidered an accompolice.  Both of which you could be arrested for.  Neither of which has happened thus far.

 I've tried contacting the D.A. trying the case and he wouldn't return any of my calls.  GAL is absolutely worthless.  Any and all information he's recieved has been handfed, and CPS said there's nothing that she's done for them to intervene much less have the children taken from her.

WHEW!!!!  Now that's out in the open, AGAIN.  I frustrated, angry, and confused.  I feel as though my back's against a wall and there's nothing I can do.  Apparently no one thinks anything of what has happened much less her actions.  However; I believe there should be something done.  At this point, I feel somewhat powerless.

can you and/or your custody atty go to the criminal trial and listen to how the BM is implicated in all of this.

also, I wonder if the transcripts from the criminal trial would be public knowledge and if you got a copy of those transcripts...can they be entered as evidence into a motion that you file for custody?

also, if you got a copy of those transcripts and gave them to the GAL to read as evidence....wonder what he would do?

perhaps also take babysteps to change the custody arrangement, because we all know how conservatively judges tend to move against women.  I wonder if you were to file for a change in sole physical custody to you and left it as joint legal custody, that the judge might be so inclined to do this.

I know one thing from my own criminal case....while it's "ongoing" you can't bring it up in a custody hearing.  Course, monster and his attorney CONSTANTLY brought it up, til my public defender had enough and attended the next hearing to protect my rights.  

You have to look at it from a "legal" point of view.  What "if" mom was innocent of this crime.  (i'm not saying she is, btw) It's not "legally" correct to remove the child from her care before the criminal case is over with.  Makes no sense to the lil guy (us) but I know my criminal trial was used in my custody case and helped monster alienate my son even more...because of it.  My public defender interrupted everyone when it was brought up in the custody case and let them know the "legalities" of bringing one unfinished case into another.  That was the last day it was ever brought up.

How ridiculus/pathetic. My ex just gave hints/maybes/I thinks to the judge - not a shred of evidence- and the court blocked me from having any time at all with my daughter, and I was the daily caregiver. It took two years and two forensics for me to see her again. Just goes to show, as if we all didn't know, how messed up courts are. But hang on. After 4 years of legal hell, the girl lives with me, and she's thriving...
