Summer Vacation CS

My best friend has custody of her 4 year old.  The father has standard visitation including 2 months over the summer.  The father moved out of state and hasn't called or seen his daughter in almost a year.  He does pay his CS.

My question is this...He is supposed to have his 2 months soon, but he will not take them.  Instead he will leave her with the child and all the bills he was supposed to have for those months.  Shouldn't he pay extra CS if he isn't taking the child during these two months?

Child support set up thru the courts is figured on a 12 month guideline, or depending on the amount of time spent with the other parent, it can be set to be paid for 10-11 months, with one-two months without.

Like this:

Yearly cs obligation = 12, 000.00
Monthly cs obligation = 1,000/mo
If the two months he has the child they agreed he didn't pay, then his monthly c.s. obligation is increased the other 10 months to be this:  1200/mo.  Make sense?  At least this is how it was done for me.  I could get cs every month regardless of when child was with father, or I could get an increased amount every month and none while visiting father in the summer.

Perhaps it is just my state, I don't know.

Good to see you here, CJ.  Better than the BS at DD, wouldn't you say?  Been reading there for a few years and it looks like it's going to hell in a handbasket.  I only read there for the entertainment value now, which is a crying shame, given the seriousness of the issues.

The best thing you could do for your case is to come here.  There are many here who have been where you are and are willing and able to help out.  You will find no name-calling or backstabbing here!
