Ex asking for custody, out of state HELP!!

My ex and I hava a very good relationship and he called today asking for help for his twin sister.

SHe and husband filed for divorce in Virginia.  She believed him when he said to save money they should both use one lawyer...HIS.

She got nothing in the divorce and doesnt' get CS, unless he feels like sending some.

On Fri she was served papers, to appear in court this fri. Ex is asking for custody.

She moved to WI over 2 yrs ago and this has been childs primary residence.

There isn't no  substantial change in circumstance.

She has hired a lawyer in Virginia.   I thought she should fight for WI to retain jurisdiction as the child has lived here so long.

Any one know anything about virgina law?  Any advice  would be great.

If the divorce occurred in Virginia, that is where the custody matter must be filed.

As part of the divorce, did she receive custody? Was she granted permission to relocate to Wisconsin? If not, that could certainlty create many large problems.  What is the basis for the Motion?

Yes, divorce was in Virginia.  Am waiting for her to call me for more info on the motion.

She sent Daughter out there for 3 weeks summer visit and ex had threatened to not return her but did.  Immediately after he filed for custody.

He has known where child was and relocation was never contested. He has even come here to see daughter.
