Dad needs help ASAP!!

Needing Help

I am step mom and gonna try and make a long story short. BM lost custody due to abuse (Physical). DCFS left child in Maternal Grandfather and step-grandmother placement because child had been living there for 5 months already, they (DCFS) never notified Dad because as they say child was already placed in a stable setting. Dad found out through child support being changed. We had child every summer up until this occured and then lost contact because of this. We initally get an attorney and try to get custody through DCFS but because Judge stated Dad was non-offending parent we have to sue them for custody and that DCFS was no longer in this case. Stepson is in long term relative placement. After years of waiting on court dates and getting post-poned for one reason or another we now cannot afford another attorney. This past school year the grandmother calls up saying you need to take your son we can longer deal with him, instantly we agree. But she wants to wait till school is out to do this so again we agree. When school is out she then again changes to visitation and then see how that goes for change of custody, it went great child, did not want to go home he told us and grandpapernts he wants to live here with Dad instead of there. Well, you would think that would be it but NO then we was told we would have to contact courts and arrange change of custody well needless to say everything we say she does not agree to even though she wrote out what she wants in papers herself. So now we are having to bend over backwards to satisfy her wants and needs meanwhile stepson is calling and begging his dad to hurry up and get him away from there. He is 14 now. She has him seeing phsychiatrist and counselors for behaviour problems of which he says he tells them he wants to be with his dad even one doctor agreed it would be good for him at this age to be able to have a relationship with his dad. Well, after searching through rules and statutes I have found the needed forms for us to file Pro Se and even located a statute that states when the non-offending parent requests custody that parent must be given custody. So with this in mind would this be something to use against grandparents or should this be used to appeal the earlier decision against DCFS.

use that information for both. give it to the grandmother and file pro se. make yourself heard. write to your senator because ultimately they are over DFPS. get yourself on the local news if you have to. We are currently having issues with DPFS and I have sent certified letters to the local office, Austin office, and senator. Send everything certified with return receipt(even to grandmother) so they cant claim they have never heard of you. I have learned with DFPS the squeaky wheel gets the grease. 95% of time they dont do their job and the 5% that does get done is done wrong. Under no circumstances does a grandparent get rights over a parent with a clean record. If this child is over 12 he gets a right to make his voice heard in court and that weighs heavy on the judge. When you make enough noise (local news) attorneys will probably come to you for a shot at DFPS. We are in the same situation with the money for a custody battle. it is rediculous that fathers have to fight this hard against deadbeat moms.
