What are the chances of a fater getting custody of his child once it is born?  What all goes into the decision of who gets custody?  By the way, I'm new to all of this!

On the average, custody is given to moms in about 90% nationwide. That figures rises or falls a bit depending on state/region.

With newborns however, that number is much higher, unless the mother is a raving junkie, prostitute, ax murderer,, you get the idea.

If both parents are of typical middle class backgrounds with no bad pasts, Dads will lose in a custody fight an overwhelming majority of the time.

BUT, most of us dont let that stop us......

OK...here's the situation...mom is a full time student who lives at home.  Mom has no income.  Dad has an established managers position and makes a decent living.  Dad has a committed girlfriend and they plan to marry.  Wouldn't it be in the child's best interest to be with Dad due to income and having two parents in the home?

No, because the child only has ONE parent in your home,,if you make the mistake of refering to your gf as the mom figure,, you will NOT make friends in court.

As far as the childs mother living in her parents home and going to school,, believe it or not, that plays in her favor. She is in a WELL established stable home and seeking to better her life.

Sorry, I know you may not want to hear that,, but its how it plays in court.

Your best option right now is to try to work out things amicably. If you cant, then retain an attorney, do your best, and pray for split custody.

Income will play no role in getting custody of a child. Your best bet is to try for 50/50 and if you try for custody try to prove that you would be the parent most willing to faciliate a relationship between the child and other parent.

You really have no rights to the unborn child until paternity is established thru the courts, file for paternity testing now so when child is born they will do it then, at the same time file visitation or custody papers.
