Another question about our custody case

Hi,

Even though we were not granted our motion to intervene we were all ordered to go through court ordered mediation. This included My husband and I, LG, mother and LF. We were told by the judge the baliff would schedule this. Baliff said we would reiceve this notice in the mail.

LG had contacted me and said we have mediation at children services. I knew this didn't sound right because CS doesn't have mediation. I called the courts and CS neither one of them knew of this but the Social Worker did. We went.

My husband suggested day care be cancelled for nephew due to one of us being here all the time, and LG isn't even working. They agreed but now after 2 weeks, they never cancelled it...the reason...LG hasn't decided if she wants it cancelled. The reason we were given was so she could have a break.

I told the Social Worker I don't appreciate our tax dollars being spent so foolishly when the child has a loving family here to care for him.

I was also told the results of the pat. tests are in...no one is telling the results.

My questions are...

1) Will my "bad mouthing" to the social worker be used in court?

2) Will this "mediation" be null and void since it wasn't the court ordered mediation? (There was no mediator there)

3) Is there anything we can do about the daycare issue?

4) When will we be notified of the pat. results?

5) How long will it be until the courts find out the results of the pat. tests?

Evidence discovered as the result of mediation is generally inadmissible in court. But, it does no good to say anything bad to anyone during this process, because you just put the other peope involved on their guard.

If there was no mediator, then it wasn't mediation. It was a settlement conference. The evidence is still inadmissible.

Daycare will be ordered if it aids the parent receiving child support in obtaining/maintaining employment or education/training in pursuit of such employment. Otherwise, the court has no jurisdiction to order daycare, and you should object  to any court order forcing you to pay for daycare, unless the court specifically finds that the previously-stated grounds exist.

Varies by jurisdiction. I don't know.
