How do I handle this?

Being the NCP with, in my opinion, limited visitation, how do I deal with the following?

My son had an appointment scheduled for today, during the time of my 4 hour visitation. My X called me on Sunday to ask what I was going to do about it. I told him that I was going to take my son to the appointment.

He informed me that no, I was not, he was getting out of work early to take him. I told him that I did not care that he went, but I would take him, as it was my period of visitation.  He refused to let me. At that time I informed him that any further appointments should not be scheduled on my time.

During the appointment, I was berated  and screamed at and accused of insurance fraud by his new wife. (All absurd...but no matter.) They then scheduled his appointment for next month, you guessed it, during my 4 hours on the EO Wednesday.

I just now read your response to johnw (below) and believe that pertains to my situation as well. I had previously sent a letter to him advising him that I would file contempt if he did not allow my son to come to my home after school as stated per the order.

As I have previously advised him(as well as cc'd the courts) and currently have a few other contempt issues such as failing to provide medical insurance information during my periods of custody: failing to advise me that he has changed Dr.'s...

1.)Do I forgo the certified letter and just file contempt?

Thanks Soc!

Forgot to ask this part...

1.) Do I demand/request that next months appointment be changed? Or do I leave it as is?

If you want to take him, then keep the appointment.

Otherwise just reschedule it during his time and tell dad.

Isn't this up to you?  Remember it's YOUR time.

I don't know the nature of the appointment, but if it is closely related to the child's health and welfare, then you should consider the consequences of not bringing the child, if the issue is later raised in court as evidence of your affirmatively acting against the child's best interests. If it's not so important, then do whatever you want.

Tricky subject...it's a monthly checkup for his ADHD medication.

They were given several options as to when to schedule and after examining the calendar, they chose  the one day of the the  week that I have a 4 hour visitation. I guess I will leave it as is for this month.

Ughs at me for forgetting today was Good Friday, as I was going to head down to the court house to file the contempt charges.

Thanks for all your help and a Blessed Easter to you and yours.

Since that's the subject of the appointment -- I would think you would want to be 100% involved and THERE.

It's not a matter of me not being there.  I'll be there no matter when it is. It's a matter of scheduling during my EOW 4 hours, and refusing to LET me take him.

You take him.

I get it (now)!
