VERIFIED AGREED MOTION TO MODIFY CHILD CUSTODY, VISITATION, AND SUPPORT

Rxxxxx Kxxxx Mxxxxx, Petitioner, and Txxxxx Dxxxx Mxxxxx, Respondent, do hereby stipulate by and between them the following items:

1.) That on September 2, 2002, the Superior Court of Worth County Georgia issued a Final Judgment and Decree of Divorce between the above mentioned parties which awarded the parties joint legal custody and awarded the Petitioner sole physical custody of the parties minor children Kxxxxx Exxxxxx Nxxxxxx Mxxxxx, Txxxx Kxxxx Mxxxxxx, and Bxxxxx Axxxxx Mxxxxx,

2.) That on May 29, 2003, the parties entered into an agreement whereby the minor children Kxxxx, Txxxxr, and Bxxxxx would reside with the Respondent until June 1, 2004 and that the parties would alternate physical custody of the minor children yearly thereafter;

3.) That the minor children Txxxx and Bxxxxx returned to live with the Petitioner in XXXXX, Georgia on January 17, 2004;

4.) That the minor child Kxxxxx remains in the physical custody of the Respondent.

WHEREFORE, due to the change in circumstances as stated herein and upon agreement of the parties, Petitioner and Respondent respectfully request that this Court modify the Final Judgment and Decree of Divorce entered in this cause on September 2, 2002 in the Superior Court of Worth County, Georgia, as follows, to wit:

1.) Terminate Petitioner's sole physical custody award and award Petitioner with primary physical custody of the minor children Txxxx and Bxxxxx, and award Respondent primary physical custody of the minor child Kxxxxx;

2.) Modify the existing visitation order and incorporate the attached parenting plan into the modification;

3.) Modify the existing child support order to reflect the change in physical custody of the minor child Krystyn from the Petitioner to the Respondent;

4.) Incorporate the attached copies of two Missouri Form 14 as indicated for split custody arrangements into the child support order;

5.) For such other and further relief as the Court may deem just and proper in the circumstances.

You're making this WAY too complex. If you have agreed with the other party on the terms and conditions of a settlement, and you want the court to order it, then just ask for it directly:
