Child support from a jail cell . . .

Hey Soc,

My daughter is pregnant. The baby's father assulted her several weeks ago.  They were never married. We are waiting for him to be picked up on a variety of felony charges. He was/is also on parole and has at least 2 yrs back time to serve. We are in PA, Phila county.

A friend told her she Must file for custody or he will be able to take the baby and disappear when he gets released.

The same friend told her she will not be able to get CS if he is in jail and advised her to not bother trying.

The father already has a 2 yr old he neither sees or supports.


question
 
1) does she have to file for custody as they were never married?

2) Will she be able to file for CS even though he will be in jail by the time the baby is born?

No. But she must file a paternity suit if she wants child support, and then it is up to the father to motion the court for custody/visitation.
