Hi Socrateaser:

DH's Court Order says "Expenses not covered by health insurace for the children will be paid 75% by Petitioner (DH) and 25% by Respondent"

1. Does this include the monthly premium you pay for coverage?

2. If it does, does exwife have to send copy of receipts she pays each month to DH, so he can reimburse her?

I'm sorry, I'm going to have to back away from my earlier "no." Your order says that "expenses, not covered by health insurance...". This is bad wordsmithing, in my opinion.

The order implies that the expenses must be healthcare expenses, because the sentence relates to heathcare. But, expenses could also be read to mean, ANY annd ALL expenses, not covered by health insurance, and not just healthcare.

One could quickly argue that the cost of the insurance IS an expense, therefore it must be divided per the court order. However, one could also argue that expenses means healthcare expenses not covered by insurance, and not part of the insurance premium.

Bottom line is that your facts leave it in the gray area, which means that to get any certainty, you will need to file a motion to clarify.

Ok as i look throught the actual Child Support worksheet, the child support amount that the exwife atty calculated was just based on each other salary and exwife got an $10 extra education adjustment. They didnt include anything on medical premium but the actual order states "75% of medical expenses not covered by medical insurance." I dont know if this makes a diference or what it means for that matter.
1.Is there a specific time frame by when you have to send copy of medical bills to the other parent to get reimbursed?

2. Does medical expenses include dental and vision?

3. SHould premium be included in the Child Support amount?

None of this is specified in the Court Order.
