Any legal recourse?

I have custody of my 9 year old daughter. She visits with the NCP EOW and starting last school year, spends the night with NCP on Wednesdays so she may attend choir practice at his church.  

Three times last school year, her stepparent left her home alone on Thursday mornings.  SP went to work, tdropping biological children with grandparents, then off to work leaving MY Child home alone until NCP got off third shift. The stay home alone time was generally 45 minutes to an hour.

After learning about this, I confronted NCP.  Was assured this would never happen again.  Yes, it has started happening again. NCP supposedly gets angry with Step, but does nothing to prevent this from occuring.

!. Can I do anything legally to prevent this from happening?

You could file an OSC for a temporary restraining order, requesting that the court order that the child not be left in the care of the step parent. After that, if the behavior continues, you would have to file for contempt.
