Final degree gives tax deduction in alternate years to each Parent. CP refuses to sign the required IRS form so the NCP can claim the child.

1. Would you sue in Family court for contemp or small claims for the amount of tax refund that the NCP lost due to CP refusual to sign?

Neither (and it's an "exemption" not a "deduction"). I would take the exemption and attach a copy of the court order to your 1040 Return, showing that you are entitled to it with an explanation that the other parent refuses to sign the required IRS form.

Then I'd just wait for a response from the Feds. More than likely they will give you the exemption.
