DSS Report

I am pro se. My case is looking real good at this point. Trial soon.

Court ordered DSS investigation of BM due to excessive absences this school year.

Court and custody evaluator has copy of DSS report. BM was pro se but recently retained an attorney whom I am sure will obtain a copy of this report as well. I understand that the DSS report is pretty scathing, but short of neglect so no formal charges.

My question: How do I get a copy of this report so I can use whatever information is contained in it to develop questions to ask BM while taking testimony?

Generally, you must send the custodian of records at DSS a subpoena duces tecum and request that they produce a copy of the document to you.

You could also offer to pay opposing counsel for a copy, who would likely charge you half of the cost of preparing and serving the subpoena.

Before you do anything, call DSS and ask them what they require to discover the report to you.
