Morning Soc.

I just have a few questions.

I am NCP with visitation.  CP has full legal and physical custody.  In addition to monthly CS and maintaining insurance on the children, I pay "50% of all medical bills not covered by insurance" as stated in the paperwork.

I live 70 miles away from CP.  As of late, children have had more illnesses than usual and CP has had to pick them up from school early.  I have consistently offered to help in any way possible (and have all these offers recorded).

CP is now maintianing that I don't offer to help her by taking off work and taking the children to the Doctor.  She is also claiming to be losing salary weekly based on her leaving work early to pick up children.

As of this year, CP has yet to ask me to pick up children and take them to the DR or to keep them out of school due to an illness.

She is now threatening to get my help in this matter "one way or the other" by taking me back to court and making me pay extra money to make up for her lost work time.

She is also complaining that I do not help her with over-the-counter medications.  I have always maintained that I would pay 50% of obvious children's over-the-counter medications such as Children's Tylenol, etc., as long as she would produce a receipt (the paperwork states that she has 30 days to give me receipts of all medical bills not covered by insurance and that I have 15 days to remit payment to her).  

She consistently refuses to produce  receipts, caliming that she can't be expected to keep up with that type of paperwork, and I in turn have refused to remit any type opf payment.

At this point, even with my recordings of my constant offers to give help, I want to make sure I can defend myself in all ways possible.  I also do not want to get my lawyer involved until she makes a definite move to go back to court.

1- Technically, as a NCP with no physical or legal custody, am I in any way responsible for taking the children to the DR or taking time off work to keep the children, while ill, out of school?

2- Am I responsible for 50% of over-the-counter medications such as Lice Treatments, Aspirin, Motrin?  The paperwork states that I pay "50% of all medical bills not covered by insurance".

No. The CP is complaining that she must do the very thing that she is being paid to do: act as the children's day-to-day caretaker.

Gray area of law. Reasonable healthcare could include over-the-counter meds, but could equally be part of what child support is paid for. It will depend on whether there is case law precedent in your jurisdiction, and on the judge's broad discretion.

I don't have time to research this for free. Of course, if you want to pay me...ahem.
