I am the NCP of my 13yrd old son. We all live in the state of Missouri. In the past two years my sons grades have started to fall in school and his behavior at his mom's the CP is out of control. I have always asked for school report cards and updates but have been lied to on the progress he is making. Finally I had to get an parrent connect sign in to see all of his grades and discipline notices. Just this year he had 31 discipline notices most of them for cursing out teachers or bringing knives to school. He is failing everything including band. They finally referred him to an alternative program for kids with severe behavior issues. He is in trouble with the law for vandalism. He is a good kid who has no rules at the CP's house. He never acts like this when he is with me becuase I have rules. I have begged her to let him come stay with me so I can help him get through school but she will not here of it.

1.   Does the CP have the righ to withhold the school records from me?


2.   Do I have enough to go to court for a change of custody or at his age is it his decision?

Doesn't matter. Federal law permits you to get the records directly from the school. Send them a letter and ask for a copy of the kid's records.

If you have all of the things you claim documented in school records, then I think you have an opportunity to get a GAL appointed to investigate and report back to the court. So, I'd definitely go for it.
