Can I ask the court to grant mediation prior to them setting trial date?

If you ask for mediation before going to a full-blown trial, the court will usually grant it.

IMO, yes it would show good faith on your husband's part.  Whether or not it would make a difference is hard to say.  But you may be able to get the mother to pay legal fees if an agreement is reached via mediation and she backs out.
