MY HUSBANDS MOTHER DIED 4 YEARS AGO ,HIS FATHER REMARRIED WITHIN A YR.,THEY WHERE TOGETHER FOR A YR N AHALF THEN HE DIED.SO THAT LEFT THE 2 YOUNGER CHILDREN WITH HER ,THE  CHILDREN DIDN'T WANT TO LIVE WITH HER,SO MY HUSBAND FILE FOR CUSTODY,AS SHE FILED AT THE SAME TIME,THE CASE SEEM LIKE IT WHEN ON FOREVER,BUT COME TO FINE OUT THE CASE WASN'T FILED LIKE HIS LAWYER SAID,AND THE STEPMOTHER CASE WASN'T FILED EITHER.WE FOUND THAT OUT WHEN WE WENT TO CHILD SERVICES ON THE STEPMOTHER ABOUT HER LOCKING THE 10 YR OLD IN HIS BEDROOM (THE LOCK WAS ON THE OUT SIDE OF THE DOOR)(AND THE 16 YR OLD SAW THIS GOING ON).CHILD SERVICES SAID THAT IT WASN'T FILED,WE WENT ON LIKE THIS FOR AWHILE, THE LAWYER SAID IT WAS FILED  AND SOME OTHER LAWERS CHECK TOO AND IT WASN'T FILED.SO THE 16 YR OLD WANTED OUT SO WE MOVED HER OUT,BUT WHILE WE WAS MOVING HER OUT THE STEPMOTHER CAME HOME WITH THE TEMP. CUSTODY PAPERS WE KNEW THEN THE TWO LAWYERS HAD BEEN INTOGETHER THE WHOLE TIME.WE HAD CAUGHT MY HUSBANDS LAWYER LYING TO US OVER AND OVER,AND WE FIGURE OUT HE WAS IN WITH THE STEPMOTHERS LAWYER TOO,SO WE FIRED HIM,BECAUSE WE DIDN'T HAVE NO PHYSICAL PROOF. BOTH LAWYERS GOT AWAY WITH IT.IN THE MEANTIME THE STEPMOTHER TURNED THE YOUNGEST AGAINST US TOLD HIM LIES,BOUGHT HIM OFF, SO WE HAD NO CHOICE TO HAND THE CASE OVER TO THE AUNT AND UNCLE.THEY GOT JOINT CUSTODY BUT IT WAS LIKE VISITATION VISITS ON THERE HALF, THE STEPMOTHER  GOT THE OTHER JOINT PRIMIARY CUSTODY,ABOUT A MONTH LATER SHE MOVED 3 STATES AWAY  ,TAKING THE 10 YR OLD WITH HER.SHES BEEN IN CONTEMPT DOZENS OF TIMES AND SHES GOT AWAY WITH EVERYTHING.THIS WHOLE THING HAS SO MUCH MORE TO IT  I COULDN'T TELL ALL IN ONE DAY SO HERES THE SHORT VERSION OF IT......NOW WHAT DO YOU DO WHEN YOU CAN'T TRUST YOUR OWN LAWYER. WHAT ELSE IS THERE TO DO.  MAN!!!!IF I COULD ONLY TELL THE WHOLE THING YOU WOULDN'T LIKE THIS WOMAN AT ALL,SHES EVIL, AND I MEAN SHE IS EVIL!!!

what state are you from and stepmothers have a right to file for custody? Is she a biological parent? I'm confused

Not the OP, but she said that her husband's mother had passed away, leaving the father to remarry.  Then, the father passed away as well, leaving no bio parents to the 10 year old and 16 year old.  Apparently, the bio sibling tried to step in for custody and there were some legal mistakes somewhere, and the stepmother, I would assume as a de facto parent, stepped in and assumed temporary custody.

Does that clear anything up?
