BM has full custody,BF has visitations.BM has never had a job.BF has always payed support but has never been able to declare child on taxes.Who ever BM is with at the time husband/boyfriend always daclares child as dependent.Even thou they only work the average of 4-6 weeks a year.
1.How likely would the court be to change it,so BF can daclare child on taxes every other year.
BF and the state, support this child year round except the 4 to 6 week period.

In order to claim the exemption, the child must live in the household for the entire year, or be legally related, such as a stepchild. So, if the mother currently doesn't work and has moved in with a boyfriend at some time after January 1, 2005, then you should be able to get the court to award you the exemption for this year only, because neither the mother nor her boyfriend can make any use of it. However, if the mother is currently married and living with her husband (and the child), or she moved in with her boyfriend prior to Jan. 1, 2005, then you will lose, because the stepparent/boyfriend can legally take the deduction, and this reasonably has a value of increasing potential support money available for the child.
