Long.. Sorry.


 Ex, CP, has fought  tooth and nail to keep my partial custody to the bare minimum. She's always saying "you can have the girls any time you want them." Yet, when I calls she won't answer. I get's the girls on all of my days, but want more (as all NCP do.)

If for some reason I can't get them I make up the day... (at her convienience of course)

Within a 7 day week my ex's schedule has been going like this (last 7-8 weeks)... I take the girls to school Monday morning. She get's off work at 4pm and this is when the girls get off the bus at her house. Her gram(great gram to the girls) picks them up (no problem.)

 Ex goes to work-out and tan right after work. Gets home, maybe by 7 pm. Grandmother has already done girls homework with/for them, and they've had supper. Ex proceeds to "sponge bath" the girls. (they get 3 "baths" a week, with only one actually being in the tub).

Ex puts girls to bed at her grams house (ex lives 100 yards from gram). Once girls are asleep ex goes out to the bar. Arrives home after midnight. Gram puts girls on bus next morning.

Tuesday... girls at school.. ex is at work. Girls stay after school in a room and wait with other children to get picked up by parents. Ex picks up girls after work (4:30pm) not bad... Ex takes girls to her grams for supper. Ex puts girls to bed either at her grams or her house.

Wed of one week.... Girls go to school, Ex goes to work. Girls get home from school on bus to ex's gram. Ex goes to work-out and tan right after work. Gets home, maybe by 7 pm. Grandmother has already done girls homework with/for them, and they've had supper. Ex puts girls to bed at grams and then goes out to bar. Grams once again puts girls on bus next morning.

Wed next week... I pick girls up from school and drop them back off at ex;s grams by 8-8:30 pm.

Thursday..... girls at school.. ex is at work. Girls stay after school in a room and wait with other children to get picked up by parents. Ex picks up girls after work (4:30pm) not bad... Ex takes girls to grams for supper. Ex puts girls to bed either at grams or her house.

Friday....Girls go to school Ex goes to work. Girls get home from school on bus to gram. Ex goes to work-out and tan right after work. Gets home, maybe by 7 pm. Grandmother has already done girls homework with/for them, and they've had supper. Ex puts girls to bed at grams and then goes out to bar.

Saturday....one week, Girls come to my house at noon. I have them until I takes them to school on Monday.

Saturday the next week... Ex has girls but they spend the day with ex's mother or an aunt. Ex has "household" things to do. Ex puts girls to bed at her grams and goes out to bar.

Sunday on weeks I don't get them until Sunday evening... Girls go back to moms (ex) to get ready to come see me. Ex always drops them off eairly b/c she has other things to do.

SOOOOOOO... my question is this.

1. Shouldn't the girls be with me if ex doesn't have time for them? The girls behaviors are terrible. Over the past 5 months they've really been suffering from not seeing mom or dad much. (not by my choice)

2.What can I do?

During the summer the girls spent every day with the gram while ex was at work. The evening were the same.


Now here's aother quick question.

3. Ex doesn't have a house phone, and her cell phone does not have service at her residence. Is this safe for the girls? What if there was an emergency and she needed to call 911? She lives way out in the boonies.

There is no "should" in the law. There's just what's lawful and what's unlawful.

File a motion for a new custody hearing on grounds that the mother's consistent delegation of custody to her mother is inconsistent a court award of primary custody, and that you, as the other parent, should be awarded primary custody, as the other parent has demonstrated her unwillingness to do so.

You risk losing this battle to the grandmother, because under the present status quo, she is the de facto primary caretaker.

This is just an added fact suggesting that the other parent is not a fit daily caretaker. You could ask the court to make a separate order on this issue, and you could probably get the other parent ordered to either install a land phone or a second cell phone for the kids. But, you may end up paying for half of the bill.
