How long ago did he request the school records?

What kind of custody has been set in the case? Joint, Sole, or what?

The school may not comply with his request. In face, in my experience I'd be willing to bet that you won't get a complete record without a supboena.

Is he attempting to modify custody or just the visitation?

He may have up to a year to file the charges, but IMHO, the longer he goes without filing, the harder it will be to make the charges stick. Contempt is usually a nothing thing anyway, unless you use repeated contempts to lead to a custody change. The "punishments" for contempt are really nothing more then a slap on the wrist.

Why would he wait until he has the school records to file? He wouldn't need to submit the school records with his filing, they would be evidence used in the trial part of the case.

Is he retaining this lawyer for his case or did he just have a consult?

He has the child for the specified visitation time for Spring Break now doesn't he?

Sending the letters to her work can be viewed as harassment. Also, if her employer has spoken to her about receiving personal mailings at work, he could be putting her at risk of losing her job too. That would not go over in the court well at all.

He needs to stick to certified return receipt requested and her failure and/or refusals to pick them up are proof of her failure to comply.

She had him arrested based on a phone call? She could be gearing up to start a lot of trouble for him. He needs to be very careful in how he communicates with her and how he proceeds. A lot of women use false domestic abuse charges as a tool to further punish the man for leaving them and to keep the child away from him. It works all the time.

Your situation sounds like it has the makings to become pretty nasty real fast.

The green tracking etter from the post office is delivered to her mailbox. When the postman delivers, he scans it to say he delivered it...(no signature needed). This is proof enough. THen you can track it on-line to see when it was delivered. Stop sending it to her job....this will look very bad in court. Will she e-mail?

Also, the school records you can get almost immediatly if you go down to the school and show proof that he is the father. If you have a problem, ask to talk to the Principal. If that does not work, call the district office. They deal with it all the time....
