CS modification case dismissed.

I put in a petition May 22, 2008 for a downward modification after getting layed off from work. Childs Mother & I went to court in June and she requested an attorney so it was adjourned to Oct 8. I had two cases that day in the same bldg but different floors I got to the floor for visitation too late to sign in and the judge dismissed the case. Now I had my   unemployment benefit information and my Job search diary completed as well as some job prospects I am waiting to hear back from. I was told to file a motion which I did but have yet to serve childs mom. My question is will the judge modify my support retroactively or will I have to start over because of this mishap?  Any ideas on my options would be greatly appreciated thanks!

Depends on the judge....but you prob will have to use the new filing date. In your motion ask for it to be retroed back.
