I need help with chemical dependency eval

In court today, dh was awarded temp sole custody. Both of them were sent off for drug testing, which seems to be a joke. Bm was pretty confident she would pass, so I'm sure she knows some way around it. When dh went in, they left the room while he was giving the ua, didn't ask him to remove his jacket, and didn't give him the info he needed for the random testing the judge ordered.

Bm was also ordered to have a cd eval. The judge said that dh has to pay for the eval, so he can pick the place she has it done. We are very worried that they won't look at the background of this case when doing the eval, and she will just go in and lie and say she doesn't do drugs, and the judge will accept that she proved she doesn't have a drug problem.

Can anyone help me with this? Who should we call? Will we be allowed to give any background info?

As the ex husband, he should be allowed to be a collateral on her eval.  Do you have a county worker who is evaluating your case?  DH called the evaluator after seeing PBFH's chem eval, which she lied to no end on, and told the evaluator that he has documents to prove she was lying.  The evaluator looked at the documents and called the person who did the CD eval to ask what the recommendations would be with all the facts.

As far as the drug testing, there's really no way around it.  If they went in right away, there's really nothing they can do to change the outcome.

Ok, he's calling around tomorrow. He will ask if he can be a collateral. There is no county worker involved at this point. If it does go to eval, I think we will hire a private one. I don't know if we can afford it right now, but I don't want to take a chance on those biased county ones again. He has documentation where it was proved that she is narcotics addict from their divorce.

She did not check in for the drug test right away, but she did take it, and seems pretty confident about it.

That is awesome!!!  When is the re evaluation? Or do you get the kids now and until she tries to change custody?  Hel-LOOO we need some details.  What is the CD eval? What exactly does she need to do for that?

Is that something you can just spring on her...let her get into her old habits and then Wham!!  I'm sorry, you need to appear for a chem eval today?

What is your lawyer saying now??? *smirk* ;)

They back to court May 12. So she has to have the chem eval done before that. They are also on random ua's and she had to go in again today. If her chem eval goes good, and she passes all her ua's she may get custody back, because, as the judge said, "dh would have egg all over his face."

Personally, I wouldn't worry about it toooo much that she could be clean through it.

As you have said, she's hooked.  Even if she passed the first one, with the random tests, she's bound to get caught.  From what I have heard, meth is a very powerful addictive drug.  And if she DOES stay off of it, she'll probably replace it with something else like my SS BM did/does.  Meth is bad news, and MN is really starting to see that, atleast where we're at.  They've really been cracking down on the labs around here!

Yes.  Well, all the evals and tests came back clean for pbfh.  They know how to work the system.

She's pretty sure all her tests are clean, so I'm sure she knows they are. She said she is not going to take the eval. This weekend is going to be very messed up, I'll post more about it later. Happy Easter. Dh is either going to get the kids completely or lose them.

And I've recently heard that he certainly did not lose them!!!  Congrats!!!  Please post more details...
