Motion for Termination of Shared Parenting Plan

Background:

Motion for Contempt (pro se) filed in January against custodial birthmother for not upholding custody agreement relating to visitation. Court date in February - her attorney requested and received a continuance to file counter claim even though the magistrate tried to get them to settle.

Today:

Received a Motion for Termination of Shared Parenting Plan from attorney stating that it is in the best interest of the child. There is no other explanation contained, no reasons why it would be in the best interest, nothing!

Question:

What do we do?

Do we need to file a response?

Do we wait for the court date on April 19th and see what happens?

She has been allowing visitation since the first court date as agreed in the custody agreement, so the best interest of the child does not make any sense at all.

Any help would be greatly appreciated.  We want to file a response or determine what to do as soon as possible as there is not a lot of time left before court.

I must say that her attorney has not filed a response to the Motion for Contempt and the Motion for Termination of Shared Parenting Plan seems like a form that he just filled in her name - like he didn't have 2 months to get something filed.

I think you should post this on Soc board (the attorney on this site) but read his rules first!

Ask soc what to do pro-se, find out what you need to ask, etc.  Give a brief, but detailed history prior to quetions, which should be numbered.

Good luck!
