Can someone please help me with figuring out hours

I'm going to post on here(later on tonight) the I have figures I have done so far.

I would greatly appreciate if someone would mind helping me out to make sure that I have done this correctly.

The problem I am going to have are the holidays,and trying to figure out what days the girls are going to be out of school next year.

I'm doing this so I can find out if I can get it changed to Joint Legal/Physical custody in my state of Kansas.

a. alternate weekends from Friday at after school or work whichever is later, until Sunday at 7:00 p.m.;

b. every Wednesday from after school or work whichever is later, until 8:30 p.m.;

c. all summer except alternate weekends, every Wednesday from after school or work whichever is later, until 8:30 p.m., and except 1 week for Petitioner to have a vacation with the children;

d. alternate holidays per the attached schedule;

e. the day before or the day after Respondent's usual alternate weekend parenting time whenever the children do not have school


This is what is being submitted to the court.  My attorney didn't email me the holiday schedule which I have a copy of.  So I will post it on here after I have posted the figures.


Time spent with Father from Jan. 3rd- May 25th

The week of Jan. 3rd-6th.  39 hrs ( 5pm- 6 am, Mon, Tues, Thur)
                                       9.5 hrs( 8:30pm-6 am Wed)

Jan. 10th-13th 39 hrs  ( 5pm- 6 am, Mon, Tues, Thur)
                      9.5 hrs( 8:30pm-6 am Wed)

Jan. 18th-20th- 37 hrs.  (7 pm Mon to 6am Tue, 5 pm Tue -6 am Wed,
                                   5 pm Thur to 6 am Fri)
                       9.5 hrs( 8:30pm Wed-6 am Thu)
 

       
 Jan.  24th-27th-  39 hrs  ( 5pm- 6 am, Mon, Tues, Thur)
                      9.5 hrs( 8:30pm-6 am Wed)

Is this how I would figure up the hours?  My attoreny said not to include school hours or time at the sitters, so I'm counting the actual hours the Father not the stepmother is with them.  ( the 1-2 hours after school) I'm going off of the time that I know of when he gets home from work and estimating the time that he leaves for work.

I haven't posted the weekends.  Jus the week.  The week of Jan. 18th, I will have them on Mon until 7 pm.

I would really like the help as we go to court on Monday Dec. 13th.

It sounds right to me. Some states calculate time based not on hours, but overnights. Consult your lawyer.

That's fine with calculating the hours.

I wouldn't worry about excluding time spent with stepmother, because you don't know for sure what that is (or if he'll occasionally come home).  Stepmother isn't a sitter.

The hours spent with stepmother are a fraction of a percent overall, so just give him the benefit of the doubt and include them.  Otherwise, you're setting yourself up to argue over something so petty.

Also, just as it's your perogative to assign care of the kids during your custodial time (and it still counts as your custodial time), so too is he able to do that.

My attorney stated do not include hours spent with a sitter or while they are in school.  Only time spent with you and time spent with their Dad.


I was doing it as if the girls had to go to the sitters b/c Dad wasn't there of a morning... I wouldn't be allowed to claim time they spent with my siginficant other while I'm at work. They would consider him a sitter, so that is what I'm doing with the SM.....and who knows if she is home when they get home.

( I know she's not when ODD gets out of school.)
