2nd day of custody trial

Yesterday completed our 2nd day of the custody trial.  It's going to be a long trial but hopefully worth it.

BM continued her testimony of silly, ridculous lies.  She tried to speak of a letter DH wrote her after she filed for divorce.  A letter that states NOTHING more than DH's desperation to keep his family together.  She tried to talk about DH's alleged OCD and what the children allegedly report to her.  The judge wanted to hear none of it.  She said she doesn't care about DH's personal problems, she cares how the children are affected and that's it. What she states the children say to her is hear say, the doctor's records are hear say since no doctor ever diagnosed DH with OCD.
She is still stating the drive to pick up the children is too far for her to make with her new baby.  She moved 6x in 2 years each time further and further.  We offered a half-way point last year she refused.  She had DH arrested so she wouldn't have to make the drive on one particular weekend.  She made the children say they were sick on 2 weekends so as not to make the drive.  She planned her c-section on DH's weekend. She said SF has to work mandatory overtime every other friday during daylight savings time and then refused when we offered to provide car service $$ for him.  And now she continues the story that they have one car and SF gets home at 6PM even though the pictures she took of her new house shows 2 cars in the driveway and all her neighbors testified that they have 2 cars and SF gets home from work at 3:30PM.  I am awaiting a registration abstract from the DMV to prove there are 2 cars registered in their names.

BM's mother got on the stand and testified that DH was a bad father because he is clean.  She stated in the EXACT words and order of BM, the sis, and the father that they drive past our home and see DH's work boots, slippers, sneakers and my shoes on our porch, which is not only not true but so what if it was!  She said her new son-in-law with his 20+ arrests for beating up a pregnant woman, domestic violence, arson, assualt, etc. with a recent one last year for patronizing a prostitiute which everyone said he was "framed" for even though he plead guilty and his 5 years in prison makes him better father than DH because he is clean.  Nona did not know ANY of this.  Let's just say she walked out of the courtroom on tears.

BM's lawyer ended his direct by asking BM what she wanted to come out of this trial.  She stated she wants the children to have a relationship with their father where they see him every other weekend and talk to him on the phone every evening at a specific time.  That they alternate all major holidays and share in the joint decision making of all the childrens activities, education, etc.  HUH!  That's what the divorce judgement states.  And she has 2 contempt orders and one pending because she could not follow it .  What the h*** are we doing here, then?  She filed a 2nd amended petition in late October requesting she have sole custody, DH have supervised visitation and reduced phone contact.  Is someone getting scared?
She stated she and her family are in fear of their lives when around DH but they pull up next to us in the parking lot and come directly behind us on the line into the courthouse.  BM, 3 neighbors, her sister, her father and her mother testified the children are in danger with DH and now she says this.
BM's lawyer has taken SF off his witness list.  I guess because he would make a terrible witness with all his arrests, his 2 children he has no rights to and 3 previous wives.  But he is with the children more than DH.  We will call him as our hostile witness.
The next court date of January 7th and a day before my due date will probably be just BM cross examined by our lawyer.  Now that's going to be fun.
