 Me and my fiance recently broke up from her increasing drug and alcoholism. She made a new freind that she would go out with to the bars once a week at first.Her trips out became more and more frequent and we began having more and more arguments over the situation.She was coming home at 5am most mornings while i had to go work for 12 1/2 hour days.then she would be on the phone all day with her freinds (never worked in 5 years).Finally this past weekend it all came to a head and i told her if she went out take all her stuff and stay out.She grabbed my son and ran out the door.2 days later i recieved a pfa against me stating that i had beaten her in the past pulled guns on her etc etc to strengthen her case for child custody all of the allegations are completely false i would never hit a woman especially my fiancee ridiculous.now i have to pay my and her lawyer for the court hearing and my lawyer said there is nothing i can do about it.I cannot see my son and last i knew her freind had no power in her house and it is a local hang out for all the drug dealers and alcoholics.where is the justice for a man whom supports his family and tries to do the best raising his kids???? will be 2 months till i can even get a custody hearing!!  Iam seriously concerned for his welfare but am afraid to contact any child youth services in fear that she may begin to make up more lies and some how manage to keep me from seeing my son at all!She has a horrible temper screaming at the child and was violent twaord me on many occasion now she has turned it around and making me out to be the one that is violent.Hard to believe someone you loved and supported for 6 years could do that to you!!!

Your lawyer is correct, there is nothing that you can do until there is a couurt hearing. However, there are a number things that favor you. Your fiance stated you threatened or acted against her and not the child. As a result, you should have parenting time.   I would also suggest that you discuss with your lawyer filinga counter PFA to fight fire with fire. Use only accurate allegations that fall under the statute.
