Hey guys I got laid off here this week until end of january. I should be going back to work but the way the auto indrustry is right now who knows.

She has primary custody and I have secondary physical  <------ Fancy word for nothing

Anyhow I will be getting unemployment which is much less then I would be making if I were working. Still paying full childsupport but would it be worth it to attempt to get a reduction?

I know by time I get into court I would probally be back to work but who knows right now.

I don't think daughters mom has any interest in going back to court. What could be the chance of negotiating with her to lower the support. We both have some unresolved issues but we have both been sitting on them. (she owes me money from claiming child on my year as well as unpaid medical. )

Anyone have any luck with doing this kinda thing? Any suggestions would be appreciated.

However could I get away with the idea if and when I have no job to go back too? I would be eligible for Nafta which would pay me to go to school for 2 years. I would also have basically unlimited amounts of time to spend with the child. I would also be avaible for overnight parenting time throughout the week. I have a pretty agressive almost daily parenting time schedule. The only thing overnight parenting time would eliminate would be the need to go back and forth on a daily basis.

Daughter also has missed 10 days of school in the last marking period. I know I could make it a point to the court that I could get her to school more.

So if you don't get back to work or you do school etc. you won't have arrears building.

Seems like a pain, but if it were me, I'd be worried about covering my butt.

Can you work with your X to get her to agree, sign off on it and file it that way?

Agreed. I think you need to look into filing. DH got laid-off a couple years back. He filed for a temporary reduction. He started his own business and had equivalent income by the time court came around. The judge ordered a $100/month reduction in support for a year and a half (based on the calculation of CS he should have paid vs. the full amount he paid). The snag was, he had to pay legal fees too. He started Pro se, but she threw in all these contempt allegations and a request to reduce visitation, so he had to hire an attorney.

After all the trauma, it boiled down to break-even for him. Was it worth it? Financially and emotionally it was not. BUT there is no way to know because at the time he didn't know how long he would be unemployed.

How much longer do you have to psy CS?

Well I doubt she would be up for less money, just cause somebody has to support everbody. The kicker is she has a degree to be a registered nurse. ( i have a copy of her certificate of the .gov website) yet she is refusing to work. She kept getting stuck with different shifts and was not there when our daughter was. I was waiting on a w-2 so I could prove she could make that kinda of money. (not sure how a judge would look at it though.)  I know it's all about the power. She knows that if she is not there I will be, and you guys can figure out the rest.

I won't fall behind in childsupport because it will come out of my unemplpyment. However I won't be able to pay my bills like my mortgage and other bills with what's left.

in a childsupport case can she just simply not bring her nurse wage info?  How would I go about getting the w-2 income info if she is not providing it? Suponena it?

For instance if my ex knew I had a job making $50,000 a year and I quit that job to go work at Pizza hut for $8 an hr and all I brought to court was my check stubs from pizza hut and a w-2 from pizza hut. How would you go about finding any other  income from another job?

I only gotta pay childsupport for another 11 and 1/2 years.... lol

You don't need a W-2 to figure out how much she can make.  I don't have immediate access to the sites, but I know there are others here who can point you in the direction of websites where you can calculate potential salaries for given areas.  Hopefully someone will answer with that info.

If you get it, demand that the CS be calculated with the her potential salary, since she IS capable of earning it.
Handle every stressful situation like a dog........if you can't play with it or eat it, pee on it and walk away.......

Well that's the problem....

I'm pretty sure she was working as a nurse up until she quit because she is odviously a moron.
I don't know how to prove she was employed as a nurse at one point.

from what I have heard you cannot get someone imputed at a particular wage unless they have proven that have made that much money. Just because someone has a certificate in a certain indrustry yet have never technically worked the  job they are qualified for is not good enough I guess.

That has been the issue for quite sometime. Waiting till she got a nursing job.


Like I said, any help or sugestions are appreciated.

Bring to court her nursing license and the help wanteds from your area saying she could get any of these jobs....maybe your local hospital has a personnel bullentin board with job openings with salaries...

ok Finally had the discussion with the brick wall and she says she wants nothing to do with the decision making regarding childsupport. I want to leave it up to the friend of court she says.

So I plead my case that we can come to an agreement and the court will uphold it. Instead of going back to court and spending money on legal fees etc. She says she will not need a lawyer because my issues are with the friend of the court.

Well looks like I gotta file.

I wonder if I could also bring up the year she claimed child on taxes when it was my year if and when we go to court?

Yes, you can bring it in, but you need to also bring in the proof of what it cost you.
