BM is relocating with kids - can I get custody?

New to the SPARC forum, but here's my question:

My kid's BM (my ex-wife) is relocating to another state for a new job and is planning on taking our two young children. She has primary custody, but I have the kids over to my house about a third of the time and a close bond with both. She has not given me a formal Notice of Relocation, but I'm filing an Objection anyway. What can I do to make a good case for custody so the kids can stay here with me?

Will they stay in the same school? Is BM's family living in your state? (all family by you) Other siblings involved?  Father is involved parent...You are willing to work with mom in a generous parenting plan...I think someone just went through this and has a list of the reasons they used. I will look for it if I get a chance...Good luck!

Thanks for the input...I can move a few miles and keep the kids in the same school. BM's family is in the current area and she has none where she is planning on moving to. No other siblings...both kids are mine. Appreciate any info you know of!

What state is BM relocating to?

Ages and sex of children

What is the difference between the job she has/had and the one she is relocating for?

State is now Washington; going to California

Children are boy-7, girl-5

Current job is part-time low pay, supplemented with assistance; new job is full-time good paying, will get her off assistance. Claims can't find comparable job in current area.

It sounds like a good move for her, but devastating to the kids.

Dh and I got wind of BM trying to move to IL from WA. We filed an Ex parte (with atty) because she was going to sneak.

During the Ex Parte, judge threatened BM from the bench with jail if she moved without proper notice etc. He also "found" reasons for a full hearing on modification of the parenting plan/custody at that time.

We were fighting a Bm with all ties in WA.
DH has family in WA.
Bm was moving to marry a guy she had known less than a year. He broke it off and moved without her.

she's already provided that part for you. she plans to move thus it's a drastic change.  All i can say from there is GOOD LUCK you'll need it. My hubby went through this with his ex wife and was allowed to move 550 miles away.
