Supplemental motion for contempt repost

My lawyer drew up another contempt motion.  At the top it says supplemental motion for contempt. The motion states that the court should hold my ex in contempt for 1. not allowing me my xmas visitaiton, all 2003 holidays missed, not giving me a current telephone number to reach our daughter and it mentioned that my ex took our daug. to emergency room in NOV without notifiying me of the emergency.  We are asking for make up visitation, my ex doing the driving and trans. costs, and her paying my additional  atty. fees.

One was submitted in july for my summer visitation as well as unpaid medical bills that she owes me.  That contempt was NEVER heard (as it was pending as we were supposed to have an agreement)  The contempt was never dismissed and is still pending in court.

These are pieces of evidence that I have that show my ex is NOT letting me be a part of our daughter's life that do NOT necessarly pertain to EITHER contempt charge.

*Letter from principal stating that I am not listed as father on emergency contact info (BUT her boyfriend is listed under FATHER or male who resides in house).

*Letter from last year's teacher stating (after my asking how she was doing in school) that she wanted to hold her back (my ex told me NOTHING of this).

*Letters from teacher directed to her (but they ALWAYS send me a copy of anything that goes to her) stating my daughter has had over 25 TARDIES all of which were unexcused.

*Report card that says my daughter acts immature AND that maninly the reason for her falling behind is cuz of the tardies and absences.

*Two letters (one my ex wrote in 97 another her mother wrote in 97) both of which were filed in a court (for her domestic abuse conviction against me) stating that I am a wonderful person and both think so highly of me AND both stating (my ex and her mother) that my ex needed counseling. There has been another felony conviction for domestic abuse against my ex in 2001 and a restraining order was filed against her also.

I have not seen my daughter since OCT 2002 expect when my ex brought our daugher to mediation (holding her as leverage basically) and then took her away after mediation stating that I could not see her/ take her because I wouldn't agree to her cs amount.  I have drove to FL 3 times since OCT 2002.  I have a son who turned one today who has NEVER met his sister.

My ex has a petition to up cs and determine it in FL and a petition to modify visiation and take over the pending IL action.

COURT IS SET FOR APRIL 15, 2004

1. What does supplemental mean in regards to contempt?

2.  Will both contempts be heard on that non jury trial day.

3.  Will the petition to modify cs and visitation also be heard that day?

3. What are some punishments that regularly are given to custodial mothers who refuse visitation

4. How do I need to prepare for the contempt hearing?

5. Can I highlight phone bills to show that I haven't been able to speak to my daughter. Will it be admissable in court highlighted with her numbers highlighted?

6. Can I bring the items listed above (with*) that don't really pertain to the contempts BUT do show how my ex is being a bit$*?

>1. What does supplemental mean in regards to contempt?

Just means additional info related to the existing motion.

>2.  Will both contempts be heard on that non jury trial day.

most likely.

>3.  Will the petition to modify cs and visitation also be
>heard that day?

probably not. you don't hear a petition. you hear a motion on the petition.

>3. What are some punishments that regularly are given to
>custodial mothers who refuse visitation

write "i will be good." on the chalkboard 100 times.

>4. How do I need to prepare for the contempt hearing?

>5. Can I highlight phone bills to show that I haven't been
>able to speak to my daughter. Will it be admissable in court
>highlighted with her numbers highlighted?

yes, but it doesn't prove that you haven't spoken, only that you called.

>6. Can I bring the items listed above (with*) that don't
>really pertain to the contempts BUT do show how my ex is being
>a bit$*?

i'd bring them, but, as you said, they don't have much relevence.
