Soc, In reading another person's post I have a question.

There was a temporary court order in February 2003.  In it conditions were laid down as far as what the mother could or could not do in terms of her boyfriend watching the children and residing in the home with them.

Recently a final parenting plan was agreed on by the parties. The issue of the boyfriend was not addressed at all.  The boyfriend is now watching the children and is being given preference in watching two small girls over family members.  He also resides in the home with the children.

1.  Would the conditions surrounding the boyfriend's involvement in the children's lives still be applicable from the temporary court order, since they were not addressed in the final parenting plan or not?

Thanks,

Gran

Generally, a final judgment extinguishes all prior temporary orders. Sometimes the judgment will expressly state what if any residual from temporary orders survives final judgment. On your facts, I believe that the temporary order is no longer in force, if the final parenting plan is agreed to, signed by the judge, and entered into the court record.
