My daughter's unreasonable mother

I guess if you don't know me you really can't judge me.  I left my girlfriend and my daughter three months ago.  Well I tried to take my daughter with me but it's the only way her  mother could control me so we tried to have joint custody set up.  But she filed for child support before I even move out.  You see I used to sell drugs and after she got pregnate I stopped and got a job and am going back to college. Then after a year she decides to start getting high again.  Well she never really stopped from what I now hear.  Sure I made my mistakes but I quit everything for my daughter.  Now that I am gone and not supporting her and her drug addiction she is trying to prove that my daugher is not mine and wants me to have nothing to do with the baby.  All of this because she doesn't feel I pay her enough in child support.  The fact that I'll have my little girl for a week at a time and when she gets her back she doesn't want to have anything to do with her mother.  That's because for the first year of my daughters life her mother only looked after the baby when she had to.  After I moved out she would call and be like how do I get the baby to sleep stupid questions that she should know how do deal with.  I weined my daugher off the bottle three times and when I would return her to her mother she would immediately put her back on the bottle.  Why because it's easier to give her a bottle and walk off than to sit there and actually feed my baby.  And so now that I am trying to get custody but in Texas her off and on drug problem doesn't seem to make her an unfit parent.  Her response to this is guess what you're not even the father so I'm going to have a parternity test done and she want's to strike me off the birth certificate so I can neve see my daughter again.  All because my 15 month old baby doesn't really want to be with her and only cries for daddy and never really says momma.  I went from having my daughter every other week to being lucky to see her two days a month as of lately.  Any advice

Well, I don't believe she can "strike" you off the birth certificate.  Even if it is proven via DNA testing you are not the father.  I don't think they'd even do it if you asked for it.  Once you "upheld the child as your own", that child became legally yours in the eyes of the court, although the rules might be a little different since you were not married...

I think PeanutsDad can give you better advice than mine...

Sounds like you need to hire an atty, request a GAL or parenting investigator, document all the times you have had your child and all the time you were denied.

You can also call the local pd and ask they do a child welfare check, its when they drive by mom/dads house and go make sure the kid(s) are ok.
