Update on my Daughter . . .

Hey All,

Tomorrow is the trial. Several things could happen when we get to court. Her exbf could change his mind and decide he doesn't want a Judge trial, he wants a jury trial. If that happens the case would be continued and be reset in 6 - 8 wks. This is what I really suspect will happen. I am sure his attorney doesn't want the Judge or a jury to see my D's big preggo belly while she is testifying about how he beat her up and tried to kill the baby.

Of course he could allow the trial to continue and my D would be forced to testify about the day he beat her. This really scares me since she us terrified of him and as soon as we get to court she is a mess, crying, shaking, not good for her or the baby.

Then again he could grow a conscience and decide to end this charade  plead guilty and accept responsibility for what he did. Not very likely as any defense attorney worth his salt will recommend against his pleading. There would have to be a really good deal made for a defense attorney to agree to a guilty plea, And from what I have discussed with the ADA, they feel they can convict on the biggest charge (agg assult against an unborn) and don't seem to want to let him off on a reduced charge.


We will also have an additional trial for the violations of the RO. So far we are up to 43 letters and 1 call. (he conned a social worker at the prison to allow phone use and called here. Luckly I answered and he didn't get my D) Not sure how long it will take before that trial begins or if it will be held in criminal court or family court. I have been told the normal time frame is 8 - 10 wks before it gets listed and by that time she will be too close to her due date to testify safely.

So I am asking for prayers for D to  have the strength to make it through tomorrow. (And prayers that this part ends tomorrow).

And btw I know what Santa will be bringing me for christmas this year, a grand-Daughter . . .

You have my prayers that your daughter can get through this with peace and clarity.  I'm sure she'll probably have to testify, and I wish she could do it via videotape in another room.  Also that this ends in her favor tomorrow. Videotaped testimony could possibly be used in the trial for the RO violations.  Good luck to you and your daughter tomorrow.

When is your daughter due?  My daughter is due December 25th, and she is also having a girl :-)

Hag, I hope you know that you & your family are in my prayers,. Hope things went well today. Wish I could be there for you, the way you were there for me. I been trying to call but never seem to catch you in.
