Hello Im in Texas.

I am filing pro se on a family court Modification tomorrow and I want to make sure I do this correctly.

Question:

1. Do I include the Purposed Order WITH the modification Motion or is it a seperate filing and fee;

2. Do I take the respondents copy to have it stamped " filed" or will the clerk make a copy of the one I give her to file?

thanks in advanced.

A proposed order, assuming that one is accepted in your jurisdiction, may be submitted with the motion and without an extra fee.

You can have the clerk make you a copy of the filed doc. It doesn't need an official stamp to prove its authenticity to the person you are serving. In fact, depending upon the jurisdiction and the particular filing, it may not require any stamp at all -- merely a certification signed by you that it is a "true copy."
