A formal agreement...

Soc,

My dh is wanting to attend medical visits with his son - which are out of state appointments.  He and the bm have joint legal, with her being the cp.  The organization providing this gives free transportation to the child and one parent.  She went to the first appt. and made it clear that she will be going to the next one.

In an effort to be included, dh is wanting to have an agreement signed in which they would alternate rights to the free transportation.  We are definitely not legally-inclined and would like to know if this even sounds plausible....

DH is wanting to have this signed and then present it to the judge to make sure it is official....Its not pasting exactly correctly at the bottom where we would have parent, date, and witness to sign for each....

AGREEMENT

In the spirit of joint legal custody and in the best interest of our child, Name of child, WE agree to alternate appointments to the ORGANIZATION hospital for CHILD's ongoing burn care.  WE acknowledge that both parents have equal right to the medical care of our minor child.  

In signing this agreement, WE hereby agree that this will begin with the appointment for DATE, 2005 (or postponement date thereafter).  MOTHER, mother, will be the parent provided transportation to this appointment.  Thereafter, FATHER, father, will be provided transportation by ORGANIZATION for the next appointment (at this time DATE, 2005).  Appointments will rotate as such thereafter.  This does not exclude either parent from any appointment, as the other parent may make travel arrangements with ORGANIZATION himself/herself or other travel arrangements.  

In the event that a parent is unable to attend his/her scheduled appointment with CHILD,   they have three options:

a)   He/she may call ORGANIZATION to reschedule within a reasonable time – no more than 2 weeks later
b)   He/she may request to switch times with the other parent – agreement is to be the sole discretion of the other parent
c)   He/she may forfeit their scheduled time and resume rotations after the other parent's scheduled time

WE fully acknowledge that this is our wish to guarantee equal access of our son's medical care to both parents.

What makes you think that the other parent will sign this document, no matter what it says?

Soc, dh is wanting to ask the judge to order it so.  This would show that he is making an effort to work things out amicably and in a way where both parents have input into the child's care.  

Will she sign?  Not a chance.....but I thought part of this was the effort to work things out without the judge having to make the decisions about everything.

By the way, dh received his summons today for unpaid medical bills...it will be a relief to let the judge decide....

I'd say that you should present the doc to the other parent (by mail) with a letter requesting an agreement and if she refuses, then you'll be able to say you tried, and if she signs, then you can file a motion to have the court order its terms using the agreement as evidence.

You could format it as a stipulated order right now, but as you don't expect the other parent to sign anyway, we'd both be wasting time formatting the doc for no reason.
