Again with these arrearages. NV put the personal judgmenet against Mr. Jola for 11K...We bit the bullet and figured just pay it and were moving forward with the refi of the house. so, we are ONE week from closing and NV has stated that they will NOT provide anything to the lender showing the judgment because the order resides from jersey. So, now jersey jumps back in the picutre and says the arrearages are really 26K. Now, the lender is questioning NJ as to HOW they can have NV put a judgment against MR. Jola for 11K in MARCH, 2004 and now Oct. 2004 it is 26K according to NJ. NV followed the orders from NJ last March right?

I really need some HELP with this...

Soc, how do we file w/ the judge to recognize our figures and rule with prejudice? is it a notice of motion? do we have to notify the X?

If the tryintobe a govament worker fow the state of NJ says there are now the lovely arreages of 769.00 from May to end of Aug.....how can that be since the judge ruled the change of CS backdated to 5/31?He ruled for a lower amount.... He ruled that and they were garnishing Mr. Jola above and beyond the ruling.............gawd I am so sick of this................yeah, the arm freakin pit of america........... LOL

How do we file w/ the judge? notice of enforcement? notice of what would it be called? We can't afford a CPA to deal w/ this, it's a matter of principal now and we can prove by pay stubs, etc their errors....

Oh, and Mr. Jola just today got a copy of the garnishment from HR and there isn't even a childs name of the order, just blank...is there anything we can do about that?

according to the summons, I have 20 days to either respond or a judgment will be entered. I called the law office and have tried to work out a deal. Which to me is out of budget breaking. How do I find out what date Mr. jola was served? He cannot remember.....
I just really want the money paid and the crap removed from both of our credit ratings as we are in the mode of trying desperately to increase our fico score.

refresher:
Notice to Emancipate was to be heard July 12th. That got screwed up and sent to hearing officer. got sent back to judge. In the interim, we were receiving CS checks clearly marked *refund* and that no monies showed owed in CS.
mr. Jola called judges clerk and it was to finally go to judge sometime at the end of august, or first of Sept.

We get the court order stating the 25 year old snapped off payroll. And reduction to what we requested of 60.00 per week. Plus 28 to arrearages.
We paid off the small arrears in July.
so, we look on line and it shows a balance aka arrears of 769.00 but, the corrected amount of weekly support.

My mind just spins with how inept this state is. How do you suggest handling the balance showing?

according to one of your posts, anything that can be used against me in another forum (such as a court proceeding) that could prove me guilty constituted a special email request...........I have one of those Soc......
I have been *served* I have a very very short window of response. 19 days from today and I need some help!

memory refresher:
we had filed for emancipation of the 25 y/o and a reduction for the remaining 17 y/o. It got sent to a hearing officer and then we finally got it back before the judge. It was originally to be heard on July 11....It still hasn't gone before the judge as of friday.
What the heck could be going on?

So, we had paid off the small amt of arrearages and about 4 weeks after the check had been issued we got a *refund* check from the state of NJ for 988.50, no explanation, nothing. About a week later we get a check for the exact amount that is being garnished from Mr. Jola's paychecks. Again, no explanation.  We were starting to wonder if the X died or something. We confirmed last week she has not. We got another refund check for the same amount yesterday. They are all marked *refunds* with all the correct case info on it and everything.

Mr. Jola called the 800 line and it says that there is ZERO balance due on this account rather than what his payments are.
What do ya make of it soc?
Plus, remember....it is not like this woman to not fight tooth and nail for every penny from him and to not respond about any of this.....

the emancipation and reduction got moved back to the judge in joysey!!!

I hope that works out in our favor now! :)

Refresher: had a court date of july 7th, per the judges clerk. All was set to go, no response from the CP.

Last week we get back the notice of motion / enforce from the state of NJ certified. In it was a form letter saying that the case could not be heard and was being rescheduled for August 11th to go before a hearing officer. WTF? so, Mr. Jola gets on the phone to find out why we got all our info back? And what happened. He was explained by someone in the Hearing officer area that since it was asking for a CS reduction, that is where it would have to go. He tried to explain that this was in response to the ruling from Jan 06 that the judge said May 31, 2006 was OK to emancipate. She saw that info. She said that since he did not rule as to a change in support amount at that time, it remains the same. Until the ruling for reduction. Nice huh? She also seemed very confused though. And she said that Mr. Jola would ahve to appear. He explained the difference in geographical locations. So, she sugested to get a hold of the judges clerk again. He did that on Fri and the clerk said it never made it to the judge and that he would have to ask for it to be turned over to the judge. Oh, also, Mr. Jola was told several times that since the CP did not ever respond she would not  get a chance now either. Even if she showed up. She definitely didn't reply to the notice.

Which road do you think would be best to go down?

We did find out that Mr. Jola can simply go to a family court here in Vegas to appear so to speak. Even though he clearly waived oral argument.
Can this state get any more screwed up???????????? Geezuz!
so, the clerk is gonna call Mr. Jola on Monday or tues and let him know what can be done. But, your expertise opinion will help WAYYYY more than them.....

how do we make sure the 2500 in arrearages that Mr. Jola has been paying 121.00 per month and we pay them next week that the money no longer comes out? Do we contact CSE?

the court date for the notice to enforce emancipation and the request for a reduction is this friday. We got notification back via return receipt that the cp received papers (wthin timeframe). we haven't gotten a rebuttal, not one word...How does that work now? Can she ask for an extension without notifying us properly?

This could save us 230.00 a month if she doesn't respond. That would be halved due to the 25 year old off the payroll.

We just received notification of a 8.51% COLA. the CP already asked for an increase due to the 24 year old being snapped off the payroll back in Jan when the courts said the 24 yaer old could stay on the payroll due to her supposedly being in college. so, she was already planning ahead for an increase. BUT, since she is getting the cola, can we just say that's enough and ask the courts to get a reduction due to there is only one more kid on the payroll?

we are getting ready to submit the finalization of the termination of the 24 y/o and ask for a reduction for the one kid left on the payroll.

The one left will most likely be going to college....Now, if FERPA states taht in the state of NJ, anyone over the age of 18 is entitled to a right to privacy and they w/ not enforce ferpa...But, the adult child would have to submit a permission slip to the college permitting the father, who is still paying cs to access their records. Which is absurd to say the least. So, in our motion, can we require that the kid submit this letter? AND, if she doesn't wouldnt that ultimately make HER responsible for providing grades and proof of enrollment? Reason I am going this way is you said once that the kid cannot be held accountable for the parental actions. Such as the mom blatantly not sending these things even though they are a court order. This way, if the kid is rquired to submit the letter and doesn't, then we can file for emancipation due to lack of actions on the adult childs part...
do you see where i am going?

1 - what is the difference in filing for a reduction in CS thru a judge vs. CSE? Can CSE willy nilly make adjustments without following the guidelines?

2 - we need to file a notice to enforce order of emancipation of the 24 year old (in the last notice of motion judge said the 24 year old would be empancipated as of May 31)in conjunction w/ reducing the amount for 1 kid....How do you file those? Together? seperate? do we have to file a notice to enforce? (oh crap~!) i forgot....it's NJ....yes we need to cover our butts and file that whether needed or not............ :)
 

ps....mr. jola and i had a com' ta" jezuz meetin' since our last postings of emancipation.....he is now willing to listen........... :)

One more kid left on the payroll after this hearing as defendant agreed to emancipate the 23 year old (even though she is attending school until may, 2006) can the judge rule he still pay CS even though the plaintiff agreed to emancipate?

plaintiff stated she w/ provide yearly school reports on the next kid once she gets enrolled into college. I think 2 years from now. She has never provided any proof of enrollment before.

What is the best wording to ask that the adult child provide a written statment to the college giving her own father access to her records any time he wants? FERPA won't enforce in NJ because, the kid is over 18 and has a right to privacy....Thats the ruling we got before. another sick screw job from them huh? :)

OR, how can we make it clear that IF she doesn't send the info that support ENDS?

Now, what about this argument?
The CP is making decisions about the college education with NO imput from the NCP. Never once asked. Somewhere in the NJ statutues I thought i read something about, once the parents are divorced, etc, blah blah blah. that they are required to ONLY provide the type of lifestyle that the parents were accustomed to. Such as if the parents didn't attend college, they wwould not be held responsible for the college for their kids.
this is such a thorn in my side Soc, this paying CS for college adults, ONLY because the parents are divorced. I just don't get it.

What happens if the defendant never responds to us or the courts?

#2 - if the plaintiff did not specifically ask that the change in CS be retro to the date of filing, what happens?

Do you think it wise to include asking the NJ court to force NV to get the 11K judgment released as it was satisfied w/ the monies for arrearages paid in Jan? Should we include a copy of the monies paid to the CP in Jan?
If so, what is the best wording? And how to we insure it gets done?

I w/ try to be brief. This is about my nephew.

He got sentenced to 5 yrs FEDERAL prison. While he was waiting for his hearing/sentencing he got a DUI. He was in county lock up waiting for a *spot* in fed. Federal marshalls turned him over to a state lockup which is now NOT counting against his federal sentencing time. Lawyer is going to file a notice of illegal imprisonment.?

Is he being flushed down the bureaucratic toilet? I am fearing for this happening since it does so freakin easily.

We are in the process of filing our stuff in NJ, since that is where the court order has resided since the original divorce. Kids still live there.

Mr. Jola got a letter from CSE in NV stating that he has missed a payment and that this is in pursuant of the NEVADA held court order.

How do you suggest we word it so that NV doesn't think they have the order?

AND if they do want the freakin order, NV emancipates at the age of 18 and Mr. Jola has been and is paying for the 2nd 23 year old. geezuz....Are you sure I can't borrow your 5 year old? Cause this shouldn't be this screwed up.

PS - we are filing for emanciaption of the 23 year old since we never receive verification of school. An audit of the account. What would be the best wording for the other crap?

refinanced our house last fall and was forced to pay NJ 26K in blood money. NV had a judment against Mr. Jola for 11K and said they would release it once the 26K was paid.
It was, and voila. Mr. Jola lost his job and NJ states his arrearages are now 900.00 bucks. NV refuses to release the 11K judment against him until he pays the 900 bucks.

Is there some sort of interstate something stating that judments can ONLY be placed for a certain amount of CS arrerages?

If so, can you please direct me to that?

Case is in NJ, kids reside in NJ. We live in NV. Two years ago we had a court order from judge for NJ to perform an audit. They did not and unfortunately we did not push the issue.
We refied our house in Nov and the arrearages stated by NV was 11K as a personal judgment against MR. Jola . NJ says they were 26K with NO personal judgment. So, when we wanted to pay off the 11K to NV they refused to take the monies and directed us back to NJ. Title company would not put the 26 in escrow and give us time to file a motion to enforce that one court order so, we sent the 26K fed exed to NJ.

1.  Can we still file and get an audit to get it cleared up and the correct amount claimed?

2. IF we do that how on earth would we ever recoop the monies?
